Transaction Terms and Conditions

These are the terms and conditions that govern the online sale of products by BF&M Limited, BF&M General Insurance Company Limited and BF&M Life Insurance Company Limited (collectively, BF&M), (Terms and Conditions). The Terms and Conditions will tell you how we will provide products to you, how you or BF&M may change or end the contract, what to do if there is a problem and other important information.

Please read these Terms and Conditions carefully before continuing to use BF&M’s online services.

By clicking “I agree” you signify your agreement to be bound by these Terms and Conditions.

We offer a wide range of products and additional terms and conditions may apply to those products. When using BF&M’s online services (for example your Health or Pension Profile, Quote & Buy, Electronic Claims Service or Online Payment Service), you will also be subject to the applicable terms and conditions of use, guidelines and conditions for that particular service (Service Terms). In the event that these Terms and Conditions conflict with the Service Terms, the Service Terms will prevail.

Price and payment

When you complete your application for a policy, we will provide you with an indicative premium price (Quote). Any quote provided to you by BF&M is not a binding contract or agreement for BF&M to provide you with an insurance product. The Quote will usually detail the premium you are required to pay to secure your policy (Policy Price).

We accept payment by credit card (Visa or Mastercard) only. When you must pay depends on what Policy you are buying and the payment schedule you select.

If you have selected ‘recurring billing’ you acknowledge that your Policy will automatically renew upon expiration. Renewals are generally for the same duration as the original Policy. If you need to change your make changes to your policy before renewal you must contact BF&M directly. Your registered credit card will be charged in accordance with your payment schedule for the Policy. The payment schedule you select will specify on which dates your credit card will be charged (each a Billing Date).

In all cases, if you do not want your Policy to renew automatically, please follow the cancellation directions as set out in the Policy. Please note that if you cancel automated billing you will be required to make payments manually on or before each Billing Date via the Online Payment Service or other permitted payment methods.

While BF&M may warn you that a registered credit card is due to expire, it is entirely your responsibility to keep a valid credit card registered for the purposes of recurring billing. Failure to have a valid credit card registered on any given Billing Date may result in non-payment and interest charges as detailed below.

If you do not make any payment to us on any Billing Date we may charge interest to you on the overdue amount. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after a court judgment. You must pay us interest together with any overdue amount together with attorney’s fees and costs incurred by us to collect past due amounts.

If you think an invoice is wrong please contact us promptly to let us know.

You agree that we will not be liable for any loss caused by any unauthorized use of your credit card or any other payment method by a third party in connection with our website. You waive your right to dispute any payment made into or out of your account and you will bear all costs of challenging such payments with the relevant third party(s).

Any attempt to defraud BF&M through illegal and/or unauthorized use of credit cards or other methods of payment will result in immediate termination of the Policy and civil and/or criminal prosecution. In the case of suspected or fraudulent payment, including use of stolen credentials, by anyone, or any other fraudulent activity, we reserve the right to block your account and/or terminate your Policy. We shall be entitled to inform any relevant authorities or entities of any payment fraud or other unlawful activity, and may employ collection services to recover payments.

Our contract with you

Upon placing an order and receiving payment, BF&M is entering into a contract to provide you with an insurance policy (Policy) on the terms and conditions set out in the Policy documents (Policy Terms). Please ensure that you review the Policy Terms carefully prior to submitting your order. In the event that these Terms and Conditions conflict with the Policy Terms, the Policy Terms will prevail.

Following acceptance of your order, we will confirm your Policy by providing you with a Policy number. It will help us if you can tell us the Policy number whenever you contact us about the related insurance product.

If we are unable to accept your order, for whatever reason, we will inform you of this in writing and will not charge you for the Policy.

Please note that our website is solely for the promotion of policies sold in relation to risk based in Bermuda.

Providing the policy

Your rights to make changes

If you wish to make a change to the Policy you have ordered please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the Policy to include any changes to the price of the Policy or the Policy Terms. BF&M will then seek confirmation that you wish to go ahead with the change before making any amendments to your Policy or the Policy Terms.

You may cancel the Policy in accordance with the Policy Terms.

Processing of payments

We may use third party electronic payment processors and/or financial institutions to process transactions (ESPs). You irrevocably authorize us, as necessary, to instruct such ESPs to handle transactions on your behalf. You agree to be bound by the terms and conditions of use of each applicable ESP, and in the event of conflict between these Terms and Conditions and the ESP’s terms and conditions these Terms and Conditions shall prevail.

Amendments to the terms and conditions

You will be subject to the applicable Terms and Conditions and Policy Terms in place at the time that you purchase or renew a Policy with us. However, we reserve the right to make changes to our website, Policy Terms, terms and conditions including these Terms and Conditions at any time.

Our liability

We only supply policies for domestic and private use. We are not liable for any commercial/business losses. If you use our policies for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Privacy

For details on treatment of your personal information collected by or provided to BF&M by you, please review our Privacy Policy.

Waiver

If we do not insist immediately that you do anything you are required to do under these Terms and Conditions, or if we delay in taking steps against you in respect of any breaches of these Terms and Conditions, that will not prevent us taking steps against you at a later date.

Children

We do not sell Policies for purchase by children. If you are under 16 you may only use bfm.bm with the involvement and authorization of a parent or guardian.

Other important terms

Any contract entered into via this website is a contract between you and BF&M. No other third party shall have any rights to enforce its terms.

Each of the paragraphs of these terms operates separately. If any of these Terms and Conditions are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Governing law and jurisdiction

These Terms and Conditions and the Policy Terms are governed by the laws of Bermuda and jurisdiction is reserved exclusively to the Courts of Bermuda.
