BF&M WINWITHBFM DRAW TERMS AND CONDITIONS
1. The WinWithBFM Quarterly Draw (the "Prize Draw") is open to people age 18 and over, who provide their email address to register as users of the BF&M website and who have an active Home, Motor or Marine insurance policy with BF&M.
2. Employees or agents of BF&M Limited, the BF&M Group of Companies (collectively referred to as “BF&M”) or their family members (spouse, co-habiting partner, parents, children or anyone who lives in the same accommodation as the employee/agent) or anyone else otherwise connected with the Prize Draw may not enter the Prize Draw.
3. Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.
The Draws and How to Enter
4. There are four draws taking place in 2024, starting on March 31st. There is one winner per draw. Each winner will receive a $1,000.00 insurance gift certificate which can be used against a Home, Motor or Marine insurance policy. The name of the winner is withdrawn after each Prize Draw, so they can only win once per year. Customers with an active Home, Motor or Marine insurance policy at the time of the draw AND who have set up and activated an online account with BF&M are automatically entered into the Prize Draw.
The cut-off dates for each draw are as follows:
- 11:59pm on 31 March 2024;
- 11.59pm on 30 June 2024;
- 11.59pm on 30 September 2024; and
- 11.59pm on 31 December 2024.
Each draw includes all of the names of eligible users throughout the total Prize Draw period (with the exception of the winners’).
5. You are required to submit your name and email address to create a BF&M website user account. Only one entry per person is acceptable and entries on behalf of another person cannot be accepted.
6. The closing date for each of the four Draws in 2024 is as per section 4. The last submission time and date for the 2024 Prize Draw campaign is 11:59pm on 31 December 2024 and requests to enter the Prize Draw outside this time period will not be considered.
7. One winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process. The draw will take place on the next business day after the closing dates outlined in paragraph 4.
8. The winner will be notified by email or phone within 7 days of the date of each Prize Draw and must provide a copy of a valid photo ID to claim their prize. If a winner does not respond within 14 days of being notified by BF&M (via the contact details provided by the winner when signing up to the website), then the winner's prize will be forfeited and BF&M shall be entitled to select another winner in accordance with the process described above (and that winner will also have to respond to notification of their win within 14 days or else they will also forfeit their prize). If a winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the winner's prize will be forfeited and BF&M shall be entitled to select another winner.
9. BF&M Limited accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by BF&M.
10. Details about claiming a prize will be sent directly to the winner by BF&M.
11. The prize can be applied to purchase a new Home, Motor, or Marine policy, or to renew an existing Home, Motor, or Marine policy. The prize is valid for 18 months from the date of issue and is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
12. The winner may be asked to take part in promotional activity related to the Prize Draw. If you agree to do so, the winner’s image, photograph and name may be used by BF&M after the closing date of the Prize Draw for an unlimited time for publicity purposes (in any medium) and in advertising, marketing or promotional material, and without additional compensation or prior notice.
Data Protection
13. The personal data which you submit be entering the Prize Draw and by using your online account will be processed in accordance with BF&M’s Privacy Policy which can be found HERE. Our Privacy Policy describes the purposes and manner in which we may process and protect your personal data.
14. By entering into this Prize Draw, you consent to us:
- using your personal data to form a view on what we think may be of interest to you and contacting you by email about other products, services or competitions; and
- in the event that you agree to participate in any promotional activity, for BF&M to use any photograph taken of you and your name for publicity purposes (in any medium) and in advertising, marketing or promotional material, for an unlimited time. We do not sell your personal data to any third-parties for marketing purposes. You can ask us to stop sending you marketing messages and withdraw your consent at any time, by emailing [email protected].
15. BF&M accepts no responsibility for any costs, damage, loss, liability of any kind associated with the prize or outside of the insurance policy terms, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting the prize. BF&M further disclaims liability for any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Prize Draw. Nothing in these Terms and Conditions shall exclude the liability of BF&M for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
16. BF&M reserves the right at any time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, but without limitation, in the case of anticipated, suspected or actual fraud). The decision of BF&M in all matters under its control are final and binding and no correspondence will be entered into.
17. BF&M shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, pandemic, epidemic, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
18. The Prize Draw will be governed by Bermuda law and entrants to the Prize Draw submit to the jurisdiction of the courts.
